IRMAA appeal denied? The four-level ladder, explained

Two different "no"s exist in IRMAA world. Social Security can decline your SSA-44 request for a new determination, or uphold a determination you formally appealed. Either way, the formal ladder below is your path — and every rung has the same fuse: 60 days, counted from when you receive the notice (Social Security presumes receipt 5 days after its date).

Level 1 — Reconsideration (Form SSA-561-U2)

A fresh look by Social Security staff who weren't part of the first decision. File the SSA-561-U2, online through your account, or even orally by phone. This is where most fixable cases are fixed: attach the evidence the first packet lacked — the retirement letter, the corrected figures, the document that proves the event and the drop. Deadline: 60 days from the determination notice.

Level 2 — Hearing before an Administrative Law Judge (OMHA)

Request with Form HA-501-U5 within 60 days of the reconsideration decision. An ALJ at the Office of Medicare Hearings and Appeals reviews the record and can hear you. For 2026, an amount-in-controversy threshold ($200) applies at this level. Bring the complete file — this is the last level where new evidence is comfortably added.

Level 3 — Medicare Appeals Council

A written request (Form DAB-101) within 60 days of the ALJ decision. The Council reviews whether the ALJ's decision followed the law and the record — it is a review, not a rehearing, and no amount-in-controversy threshold applies.

Level 4 — Federal district court

Civil action filed within 60 days of the Council's decision; the 2026 amount-in-controversy threshold is $1,960. Realistically attorney territory — but most cases should never need to travel this far if the paper record was built right at Levels 1–2.

The rules that govern all four

  • Missing a 60-day deadline usually ends the climb unless you can show good cause for the delay.
  • You keep paying the surcharge while you climb; a win adjusts premiums back per the effective-date rules.
  • The record compounds: every level reviews what the levels below had. Build the file as if a judge will read it — one might.
Included in the $39 Kit: the reconsideration letter template, the 60-day deadline calendar worksheet, and the evidence checklist organized the way hearing offices review it.
